Terms of Use — Asha

These terms are the agreement between you and OMNYSCOPE SASU, 14 rue de rouen 75019 Paris, France, registered under 991948266, for your use of the Asha mobile application.
By downloading or using Asha, you accept these terms. If you do not accept them, do not use the app.
1. What Asha is
Asha is a meditation, breathing and sleep application. It offers guided breathing exercises, ambient soundscapes and free meditation sessions.
Some content is free. Some requires a subscription.
2. Asha is not medical care
This matters, so we say it plainly.
Asha is a wellbeing app. It is not a medical device, it does not diagnose or treat anything, and it is not a substitute for professional medical or psychological care.
If you are being treated for a physical or mental health condition, talk to your practitioner before changing anything about your routine.
Breathing exercises can cause dizziness or light-headedness. Never practise them while driving, operating machinery, in water, or anywhere a moment of dizziness would be dangerous. Stop immediately if you feel unwell.
If you are in distress or crisis, contact your local emergency services or a crisis line. Asha cannot help you with that.
3. Who may use Asha
You must be at least 16 years old. If the law where you live sets a higher age for consenting to digital services, that age applies instead.
4. Subscription, price and renewal
Asha offers an annual auto-renewing subscription.
- The price is the one displayed in the app at the moment of purchase, in your local currency, and includes applicable taxes. Prices vary by country and may change over time.
- Payment is charged to your Apple ID account when you confirm the purchase.
- The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period.
- Your account is charged for renewal within the 24 hours before the end of the current period.
- You manage and cancel your subscription in your device account settings, not in the app. Deleting the app does not cancel a subscription.
- Any unused portion of a free trial, if one is offered, is forfeited when you buy a subscription.
5. Refunds
Purchases are processed by Apple. Refunds are handled by Apple under its own terms, not by us. Request one at reportaproblem.apple.com.
Where the law gives you a statutory right of withdrawal, that right applies and nothing here removes it.
6. What you may and may not do
The app and its content — audio, images, text, design — belong to us or to our licensors and are protected by copyright.
You may use Asha for your own personal, non-commercial use.
You may not copy, extract, redistribute, publish, resell or make the content publicly available, nor attempt to circumvent the subscription, decompile the app, or extract its audio files.
7. Availability
We do our best to keep Asha working, but we do not promise it will be available without interruption or free of defects. Content may be added, changed or removed.
Asha works offline once content is downloaded, but some functions require an internet connection.
8. Liability
To the extent permitted by law, we are not liable for indirect or consequential damage, loss of data, or loss of profit arising from your use of the app.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
9. Ending the agreement
You may stop using Asha at any time by uninstalling it. We may suspend access if you seriously breach these terms.
10. Changes to these terms
We may update these terms. Material changes are announced in the app. Using Asha after a change means accepting the new terms.
11. Governing law
These terms are governed by French law.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your own country of residence, and you keep the right to bring proceedings before the courts of that country.
12. Terms required by Apple
The following applies to the version of Asha obtained from the Apple App Store.
- This agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content.
- Scope of licence. The licence granted to you is non-transferable, for use of Asha on any Apple-branded product that you own or control, and as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.
- Maintenance and support. We are solely responsible for maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, any claim that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. In the event of any third-party claim that the app infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact. Questions, complaints and claims relating to the app should be directed to OMNYSCOPE SASU, 【ADRESSE POSTALE】, France, contact@emameditation.com.
- Third-party terms. You must comply with any applicable third-party terms when using the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.
